SERVICE LEVEL AGREEMENT

STANDARDS AND PRACTICES


All clients are subject to the following terms of service which ensure our responsibility to protect each client and to provide the best services available:


Indemnification Policy

1.1

You agree to use all Web Host Pro services and facilities at your own risk. Web Host Pro specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Web Host Pro be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages.

1.2

Customer agrees that it shall defend, indemnify, save and hold Web Host Pro harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Web Host Pro, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Web Host Pro against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with Web Host Pro's server.

1.3

Web Host Pro reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from Web Host Pro's server. Web Host Pro shall be the sole judge of what violates this Policy.


Billing & Services

2.1

At this time we bill monthly, quarterly, semi-annually and annually, depending upon the plan. If you are not satisfied within your first 45 days we would be happy to provide you with a full refund (For some special offers the money-back-guaranteed day will be varied; and cPanel licenses, search engine submission, advanced SSL certificates, Domain Name registration fee is non refundable). Any custom work that was done will deduct the $30 an hourly admin fee from paid services and refund any left over balance. If the custom services are more than the service to be refunded there will be no additional payment needed.

2.2

Free domain registration requires annual or longer payment plans and renews at the normal domain registration rate after a year.

2.3

If a chargeback is done on a payment made to Web Host Pro, you will get a request to reverse the chargeback. If the chargeback is not reversed within a reasonable amount of time. We will stop the account until the chargeback is reversed or indefinitely.

2.4

We accept Visa, Master Card, American Express, Discover Card, and PayPal. For web hosting plans we will not setup your account without payment (no trial periods). Clients are encouraged to pay by PayPal as it is the easiest way to handle payment at this time. Their are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.

2.5

All Web Hosting, Reseller,and VPS plans include a full no questions asked 45-day money back guarantee. If you are not satisfied with your service for any reason and cancel your account within 45 days of the activation, you will receive a full refund minus any additional / custom work, services, or custom set-up fees normally billed at $60 an hour. This includes the 3 hour labor fee if we installed cPanel totaling $180. If the labor fee exceeds the cost of the service than no additional fees past the plan will need to be paid. Our refund policy does not apply to any additional items or services. Not included in the 45-day money back guarantee is domain registration, web design, full dedicated servers, cPanel licenses, advanced backups, and anytime if we installed services, App installer licenses like Softaculous, and any time if we installed it, SEO. No refunds are normally available after 45 days unless both parties are in agreement. Website transfers take a lot of time and work so we cannot issue a refund if a transfer was requested. All requests for cancellation must be received via a support ticket and must include owner verification. You will receive a confirmation email upon the cancellation of your account.

All Dedicated Server plans include a full no questions asked 10-day money back guarantee. If you are not satisfied with your service for any reason and cancel your account within 10 days of the activation, you will receive a full refund minus any additional / custom work, services, or custom set-up fees normally billed at $60 an hour. 2.6

SPAM free servers. We do not allow any mass mailing to unsolicited email recipients and will stop any service in the case your account is proven to be using SPAM. We will also stop new signs once SPAM from a service has been confirmed. We do not allow what's called a "drop page" where SPAM e-mails direct their links to a web page on any service. In addition we have installed anti-SPAM and Spam detecting software on all of our shared servers at root level and on our routing filters for VPS and dedicated servers. Not only do we disagree with any use of SPAM, our network providers will block IPs that have SPAM coming from them. This can leave a VPS or dedicated server unusable after multiple reports. All in all, please do not SPAM from your services at Web Host Pro or serious issues will follow. We understand in some cases normal email can be reported as SPAM, we take this into consideration with services that have been activated for longer then 3 months. Late Payments

3.1

All web hosting and reseller accounts are billed according to the dates they were first activated on. If you do not pay for the service renewal within 5 days after the due date, your account will be automatically suspended. VPS and Dedicated servers have custom situations depending on the agreement when signing up. By default there is a 5 day no payment after the due date suspension for VPS. Dedicated servers do not have an auto suspension or termination. Everything for dedicated servers is done manually after direct communication.

3.2

If you do not pay for your service to renew within 20 days after deactivation, your account will be terminated. You will receive an email reminder every 5 days till deactivation. Please contact us if you need more time! Make sure and also back up your website, just in case you forget.


Acceptable Use Policy

4.1

All services provided by Web Host Pro may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or construe violence, or material protected by trade secret and other statute.

4.2

The subscriber agrees to indemnify and hold harmless Web Host Pro and its employees from any claims resulting from the use of the service which damages the subscriber or any other party.

4.3

Our acceptable use policy is actively and strictly enforced. Illegal content or users are suspended from our network, usually within 48 hours after they are discovered, we will always inform you when and why any action has been taken to fix the issue. In some extreme cases, we will have to suspend the service right away.

4.4

Adult content and pornography is allowed. We believe it's not our place to judge what is right or wrong beyond what is legal. This includes sexually explicit or hardcore content and/or advertising. We do have strict rules against any content that can be interpreted or seen as under legal age (18) adult content. If you are unsure if your content can be interpreted as under age adult content, it's best to not use Web Host Pro.

4.5

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.

4.6

Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

4.7

Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, or trafficking, is not permitted on our network.

4.8

Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.

4.9

Fast loading websites are really important for Internet surfers, It's a win win win for you, them, and us to keep the site loading fast and optimized. This just means basically don't set a wild cron job to run your script every minute or have a page so long it takes a minute to load. Optimize images, etc... We'll contact you if there is a load issue, it's very rare and easy to fix. Each plan also has power settings to keep the shared servers running fast. The Easy plan has ten percent of the server CPU and four gigs of RAM. The Pro plan has one full CPU (two cores) and twelve gigs of ram. The Advanced plan has full power from the server. Our current shared, cloud, and VPS server specs are two eight core (sixteen total) CPU's with two hundred and fifty six gigs of RAM. Each server also uses sixteen SSD one terabyte hard drives in a raid 5 system. We keep local and remote backups but cannot guarantee they will always work. It's very important to keep your own backups as well. VPS and Dedicated servers are not backed up, so you'll need to have your own back up system in place. These are some of the best stable server hardware specs available to date. Overloading websites may need to upgrade to a plan with more power and any price changes may be removed if the abuse to the server continues for several months. WordPress websites overloading may require us to login and optimize it with security and optimizing plugins.

We have a 8 maximum WordPress install limit per cPanel account. You'll need a second account after 8 or a reseller plan to allow each one to have their own account. This is due to the load use needed to run WordPress being too high with a lot of installations on one cPanel account.

 


Limitation of Liability

5.1

Web Host Pro shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from our servers going off-line or being unavailable for any reason whatsoever.

5.2

Furthermore, Web Host Pro shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from any of our servers. All damages shall be limited to the immediate termination of service.


Disclaimer

6.1

Web Host Pro cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning.

6.2

Certain services provided by Web Host Pro are resold. Thus, certain equipment, routing, software, and programming used by Web Host Pro are not directly owned or written by Web Host Pro. Moreover, Web Host Pro holds no responsibility for the use of our clients accounts.

6.3

If any terms or conditions are failed to be followed, the account in question will be automatically deactivated.

6.4

We reserve the right to remove any account without advanced notice for any reason without restitution as Web Host Pro sees fit.

6.5

Web Host Pro retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
